1. Acceptance of Terms

By accessing or using the Encore mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App.

2. Description of Service

Encore connects fans with live music artists, enabling:

• Fans to send song requests with tips to performing artists
• Artists to receive and fulfill song requests
• Audio verification of song playback
• Automatic refunds if requests are not fulfilled

3. User Accounts

3.1 Registration

You may use Encore as a guest or create an account. Account holders must:

• Provide accurate information
• Maintain account security
• Be at least 13 years old (18 for artist accounts)

3.2 Account Types

• Fan Account: Send song requests and tips to artists
• Artist Account: Receive requests, go live, and accept payments

4. Payments and Fees

4.1 Platform Fee

Encore charges a 10% platform fee on all transactions, which includes payment processing costs.

4.2 Payment Processing

• Payments are processed through Stripe
• Artists receive payouts according to Stripe's schedule
• All amounts are in USD unless otherwise specified

4.3 Refunds

• Requests not fulfilled within the specified timeframe are automatically refunded
• Refunds are processed to the original payment method
• Platform fees are not charged on refunded transactions

4.4 Tips

Tips sent to artists are non-refundable once the request is fulfilled.

5. Artist Responsibilities

Artists using Encore agree to:

• Only go "live" when actively performing
• Make good-faith efforts to fulfill requests
• Comply with venue rules and copyright laws
• Maintain accurate profile information
• Respond to requests in a timely manner

6. Fan Responsibilities

Fans using Encore agree to:

• Submit appropriate song requests
• Not abuse the refund system
• Not harass artists or other users
• Provide accurate payment information

7. Audio Verification

Encore uses audio fingerprinting technology to verify song playback. By using the App:

• Artists consent to audio verification of their performances
• Users acknowledge that verification may not be 100% accurate
• Verification data is processed in real-time and not stored

8. Prohibited Conduct

Users may not:

• Use the App for illegal purposes
• Submit fraudulent requests or payments
• Harass, abuse, or harm others
• Attempt to circumvent security measures
• Use automated systems to access the App
• Infringe on intellectual property rights

9. Intellectual Property

• Encore and its content are protected by intellectual property laws
• Users retain rights to their own content
• Users grant Encore a license to display their content within the App

10. Disclaimers

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE:

• Uninterrupted or error-free service
• Accuracy of audio verification
• Artist availability or performance quality
• Specific transaction outcomes

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ENCORE SHALL NOT BE LIABLE FOR:

• Indirect, incidental, or consequential damages
• Loss of profits or data
• Service interruptions
• Third-party actions

Our total liability shall not exceed the fees paid by you in the past 12 months.

12. Indemnification

You agree to indemnify Encore against claims arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of third-party rights

13. Dispute Resolution

13.1 Governing Law

These Terms are governed by the laws of the State of New York, USA.

13.2 Arbitration

Disputes shall be resolved through binding arbitration, except where prohibited by law.

14. Termination

• You may delete your account at any time
• We may suspend or terminate accounts for Terms violations
• Termination does not affect accrued rights or obligations

15. Changes to Terms

We may modify these Terms at any time. Continued use after changes constitutes acceptance.
